PAN-Aadhaar Linking: Penalty & Process in 2026

Updated 2026-07-29 · By KyaTax

The deadline to link PAN with Aadhaar has already passed, and PANs that remain unlinked are now inoperative — which can quietly block your ITR filing, refunds, and everyday banking. Here's exactly where the PAN-Aadhaar linking requirement stands in 2026, what the late fee costs, what an inoperative PAN stops you from doing, and how to fix it.

The Legal Requirement — Section 139AA

Section 139AA of the Income Tax Act makes it mandatory for every person allotted a PAN (who is also eligible to obtain Aadhaar) to link the two. This requirement has been in force for several years, with the government extending the compliance deadline multiple times to give taxpayers more time.

Current Deadline Status (2026)

The linking deadline was 31 December 2025. From 1 January 2026, any PAN that has not been linked with Aadhaar has become inoperative. There is no indication of a further blanket extension — if your PAN is still unlinked at this point, it is already inoperative and needs to be fixed through the late-linking process described below, not by waiting for another deadline extension.

Late Fee — Section 234H

To link a PAN after missing the original deadline, you must first pay a late fee of ₹1,000 under Section 234H. This is a one-time statutory fee — it does not increase the longer you delay, and it must be paid before the linking request itself can be submitted. It is a fixed government fee, not a discretionary penalty, so there is no way to get it waived except through a specific relief the government may separately announce.

What an Inoperative PAN Stops You From Doing

Bank & demat accountsCannot open new accounts; existing PAN-linked transactions may be restricted
High-value transactionsTransactions that mandatorily require quoting PAN cannot be completed

How to Check Your PAN-Aadhaar Linking Status

  1. Go to the income tax e-filing portal at incometax.gov.in.
  2. Under "Quick Links" on the homepage, click Link Aadhaar Status.
  3. Enter your PAN and Aadhaar number, then click "View Link Aadhaar Status."
  4. The portal will show whether your PAN is already linked, pending, or not linked at all.

Step-by-Step: How to Link PAN with Aadhaar Now

  1. Log in to (or visit without login) the income tax e-filing portal and select Link Aadhaar under Quick Links.
  2. Enter your PAN and Aadhaar number and click "Validate."
  3. If the late fee hasn't been paid yet, the portal will prompt you to pay it first — this redirects you to the e-Pay Tax service.
  4. On e-Pay Tax, select the relevant minor head for PAN-Aadhaar linking fee, pay the ₹1,000 via net banking, debit card, or UPI, and download the payment receipt.
  5. Return to the Link Aadhaar page, confirm the payment has been captured, and submit the linking request along with your name and date of birth as per Aadhaar.
  6. You'll receive an acknowledgement, and you can track the request status from the same "Link Aadhaar Status" page.
  7. Reactivation and status update generally take around 30 days from successful submission.

Who Is Exempt From This Requirement?

Certain categories are exempt from mandatory PAN-Aadhaar linking, including residents of Assam, Jammu & Kashmir, and Meghalaya, non-resident Indians as per income tax records, individuals aged 80 years or above at any time during the year, and individuals who are not citizens of India. If you fall into one of these categories but the portal still shows your PAN as inoperative, you may need to submit supporting documents to your jurisdictional assessing officer to have the status corrected.

Frequently asked questions

What is the penalty for not linking PAN with Aadhaar?

A late fee of ₹1,000 under Section 234H is payable before you can link an unlinked PAN with Aadhaar. This is a one-time fee, paid regardless of how long the PAN has remained unlinked or inoperative.

What happens if my PAN becomes inoperative?

An inoperative PAN cannot be used to file an income tax return, TDS/TCS is deducted at a higher rate (typically 20% under Sections 206AA/206CC), pending refunds are held up, and you cannot complete PAN-based financial transactions such as opening a bank account or a demat account until it is reactivated.

How long does it take for PAN to become active again after linking?

After you pay the ₹1,000 late fee and submit the linking request, it typically takes around 30 days for the PAN to be reactivated and for the linking status to be updated on the income tax portal.
